ethics our local newspaper published an article about a local boy and used (apparently) his senior picture with the article. The parents either scanned the picture or it was on a CD and sent it as a JPEG to the editor of the paper. The photographer who took the picture is now threatening to sue the paper for copyright infringement. Since I am a photographer, the editor asked me if my opinion. Does this other photographer have a case. I told her that I'd look into it. Anyone know the answer to this?

Nah, when you use for actual news or to satirize or critic, it come's under fair use. You can show a copyrighted image on an album cover in a music critique article. So, having said that, insert disclaimer about not being an actual lawyer here:

Gregory is correct. The photo was used for editorial use and not for commercial use.
