Photography Question

Carol Preflatish

On the other side of the camera

My husband participates in Revolutionary War reenactments at a State Park. I have photographed him many times, but now there is another photographer that is taking photographs and videos of all of them that he is selling on his web site. The participants are recognizable in the photos and videos. The photographer has never asked them to sign a release form. Since my husband is a volunteer on behalf of the State Park, does the photographer need him to sign a release form in order to sell the photos for profit? Thanks.

I'm not a copyright lawyer, but I would expect that if the photographer is selling the images from a website, he would need a release, either from the individual reenactors, or one for the organization. If simply displayed in a gallery, or for editorial content about the event, then he probably doesn't need releases.
