copyright laws I have created a magazine cover for a client and placed their picture on it. The title of the magazine is well known. Is it an acceptable practice to do this for clients and would there be any problem in my using this magazine cover as an advertisement in the form of a postcard for mailing. Thanks, Keith

Magazine covers, say like the cover of Time Magazine, are copyrighted in terms of their format and typestyle. They're also trademarked. Greg may have some particular insight into this issue that I'm unaware of. OTOH, your client should buy the opinion of an attorney who specializes in intellectual property law. Show the lawyer a full scale mock-up of what you're proposing and get THEM to stand behind the decision with an opinion letter that both you and your client could rely on as a defense (advice of counsel) in the event the magazine publisher disagrees with Greg. As a primary approach first, contact the magazine and ask them directly. Chances are they'll refer you to their legal staff and ask for the mock-up as well along with the text for the advertising. Don't be too surprised if they turn you down.
